EIP and Earthjustice notify EPA of intent to sue for failure to protect communities from toxic hazards

July 18, 2012

EIP notified the USEPA that it will file suit on behalf of Air Alliance Houston, Communities In-Power and Development, the Louisiana Bucket Brigade, and Texas Environmental Advocacy Services under the Clean Air Act unless the Agency revises methods used to estimate refinery emissions. Numerous studies show that current methods underestimate emissions from some units by an order of magnitude or more. EIP and Earthjustice also filed notice on behalf the groups listed above and California Communities Against Toxics and the Del Amo Action Committee to force EPA to meet long overdue deadlines for upgrading refinery emission controls and setting standards that protect downwind communities from risk.
