What is the TVA case about?

  • In 1999, the Environmental Protection Agency (EPA) brought an administrative enforcement action against the Tennessee Valley Authority (TVA) for failing to comply with the 1977 New Source Review requirements of the Clean Air Act. That law requires companies to apply for permits and install state of the art pollution controls when plants built before 1977 are physically modified in a way that makes them more likely to increase pollution.
  • The EPA alleges that TVA made modifications at 8 power plants, mostly in the late 1980?s and early 1990?s, by upgrading power plants with major new components like cyclones, furnace walls, boilers, superheaters and economizers, without also upgrading pollution controls.
